1. About StaysAlert
StaysAlert is a market-monitoring and recommendation service for holiday-let and serviced-accommodation properties. It reviews relevant market evidence for a specified stay and may provide guidance on price and minimum-stay decisions.
2. Guidance, not a guarantee
Recommendations are based on the information and market evidence available at the time of review. They are guidance only and do not guarantee revenue, occupancy, bookings, ranking, conversion or any other financial or commercial outcome.
You remain solely responsible for your property, listing, prices, minimum stays, availability, booking settings and every decision or change you make. StaysAlert does not make changes to your listings automatically unless separately agreed in writing.
3. Market evidence and availability
StaysAlert aims to assess genuinely bookable alternatives for the relevant dates and guest party. Market information can change quickly and may be incomplete, unavailable, inaccurate or affected by third-party platforms, availability rules, fees, outages, restrictions or data-access limitations. We do not warrant that every relevant alternative will be identified or that any information obtained from a third party is complete or error-free.
4. Your information and use of the service
You must provide information that is accurate, current and lawful to share. You must not use StaysAlert in a way that is unlawful, misleading, fraudulent, harmful to others, or intended to disrupt, reverse engineer, copy or interfere with the service or its data sources.
You are responsible for ensuring that you have the necessary rights and permissions to provide any property and listing information to us.
5. Intellectual property
StaysAlert, its branding, methodology, software, content and materials are owned by or licensed to us and are protected by applicable intellectual-property laws. Subject to these terms, you may use service outputs for your own internal property-management purposes. You must not reproduce, resell, publish, distribute or make them available to others without our written permission.
6. Availability and changes
We may change, suspend or discontinue any part of the service where reasonably necessary, including for maintenance, security, legal compliance, third-party platform changes or service improvement. We will take reasonable steps to minimise material disruption where practicable, but do not guarantee uninterrupted or error-free availability.
7. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, StaysAlert is not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, missed bookings or losses arising from your use of, reliance on or inability to use recommendations or third-party market information. Any remaining liability will be limited to the extent permitted by law.
Production review required: the financial cap on liability must be agreed once commercial terms and charging arrangements are finalised.
8. Cancellation and termination
Either party may end the service in accordance with the commercial arrangements agreed for the relevant service. We may suspend or terminate access where there is a material breach of these terms, unlawful use, a security risk or where required by law.
Production review required: subscription length, notice periods, refunds, cancellation charges and any onboarding commitments have not yet been finalised and must be added before production use.
9. Privacy
Our use of personal information is described in the Privacy Policy.
10. Governing law
These terms and any dispute or claim arising from them are governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where applicable law provides otherwise.
